MORE CRIME AND PUNISHMENT MADNESS

The Post reports a man was attacked by a ratbag in Porirua, resulting in his face being so massively shattered, he had more than 140 nuts and bolts inserted in his face to strengthen the rebuild.

The offender’s colleague also attacked another bloke, hitting him with what the judge described as a “cowards punch”, leaving his face badly gashed.

Both accused pleaded guilty.

In Australia, Britain, or the USA, the offenders would be imprisoned for terms between 10 and 30 years.

Here? You guessed it. Home detention for respectively nine months and seven months for the two offenders.

This is insanity and I’ll offer generous odds both pieces of rubbish will offend again. And why not given the repercussions are so absurdly light.

Our judiciary must be held to account in cases like this.

Enough’s enough. You are so right. It’s ludicrous. Another example – the “ex-All Black’s daughter”. Pissed, runs over a chap, kills him, drives on – is eventually found – tells the court how dreadfully sorry she is and has not had a drink since – then photos surface of her laughing and drinking before court. She too got home detention. In the USA, a minimum 20 years.

Total agreement Sir Bob, I wonder what the punishment would have been were the victim closely related to the dudge who handed down this pathetic sentence.
It’s past time for the judiciary to start recognizing first where their extremely generous salary with all its lifetime perks is paid from, and secondly they need to understand that some of this walking excrement will never be rehabilitated and the duty is to protect society from these people.

As an experiment….. The victim with the smacked/destroyed face, should give the judge a good smack in the face… I
It would be really interesting to see what kind of sentence he might get ??
The judicial system would feel conflicted…. wanting punitive punishment for a crime against one of their own….

So true, an Auckland woman overfeeds her dog, called Nuggy due to its love of chicken nuggets, and she gets 2 months in jail and a $1225 fine. The justice system is completely broken and the judges responsible should resign.
The SPCA took this prosecution so not more support for them.

A reflection of left wing judges, including the precedent they have created during previous government….And I am note holding my breath for this to be fixed with the present one…There’s bigger holes in the sift than this one…

Might be also a reflection of no space in prisons, but Id jam them in anyway..

If I had the money and knew the full circumstances, I would consider privately challenge the verdict….the crown prosecutor more likely wont as they have no teeth…and it would take a year or more to get a retrial…

All a reflection of very poor governance over the past 3/4 decades…where the state is near bankrupt…

Might I suggest avoiding Porirua and the like between times…if you cant take justice into your own hands…

Why is there no appeal by police on the sentence, and if not currently able, how quickly can the law be changed so that public expectations can be met ?

Dear Bob , it’s the NZ way to give open home detention to some very serious offending , which is insane as you say . Overseas these muppets would be locked up .
I saw the other day an offender for murder was on home detention waiting trial and dealing drugs .
Why is home detention deemed a punishment as it beggars belief ??

Exactly, NZ governments( especially of the left ) seem to pride themselves on departing from common sense on social issues and thereby considering themselves as “leading the world ” with their brave ( foolish!!!) new thinking. If they would take their inspiration from Singapore rather than sociologists we’d be a lot better off on every measure.

we’ve had our avocado tree stripped of this years fruit, 3-4 hundred , nashis are gone as are the plums, the missus is in tears after all her efforts, i can do home detention…

There seems to be little or no thought given to a victim in these types of cases, just the errant belief by judges that the miscreant, if treated fairly and given a light sentence, will reform his wicked ways and never offend again.

I propose that when criminals who are given given a light sentence (inevitably) reoffend, the sentencing judge is also sent down for a good stretch. Thus achieving the dual benefit of ridding our system of woke judges and reinforcing the knowledge in the remaining judiciary that the general public is sick and tired of the “wet-bus-ticket-slap-on-the-wrist” treatment of criminals.

Typical of our “justice” system.
There was the case of a man who strangled his partner (killed her) and got home detention in the same house that he committed the crime.
Another one was the woman from upper Hutt who stabbed and killed her partner. Her sentence? Home detention again !!

There is no other inference to take from the attitude our judiciary other than they have total contempt for the common person or they, (judiciary) are naive.
The former seems most likely and appears to most, simple vindictive narcissism.
Don’t come back with ” our hands are tied, it ‘is’ the law as applied ” ; Judges must be aware of this, they have a voice why do they continue to punish the law abiding citizen.
Why have we reached this point?
Return NZ law to consequence, responsibility, punishment.

No punishment = No law = No judge required
No reason anarchy isn’t visited upon us ‘all’.

Law and order systems tend to hold up a mirror to the society that produces them. NZ seems to have created two distinct classes of people with different rules and expectations of behaviour.
When these two classes intersect we get this kind of absurdity that SRJ describes.
The sentence is doubly absurd because the offenders will have multiple convictions but nothing to lose from another conviction, so the law is neither punishing nor protecting.

An assurance we can take prior to dealing with the NZ justice system, is the likely outcome will be an injustice !

Well said Sir Bob, i recall many years ago in Britain when some low life offended, the Judge leaned over, faced the accused and said: “your parole officer hasn’t been born yet!”. we could with a few judges like that here!
